Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')(FOIA)

Thank you for your email dated 4 September 2012 in which you made a request for access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of access to information held by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked: 

  1. 1. How many people have been charged with using a mobile phone whilst driving in South Tyneside between:
     a) April 1, 2004 – March 31, 2005
     b) April 1, 2009 – March 31, 2010
     c) April 1, 2010 – March 31, 2011
     d) April 1, 2011 – March 31, 2012

  2. 2. How old was the youngest driver stopped and charged? What were the circumstances?

  3. 3. How old was the oldest driver stopped and charged? What were the circumstances?

In response:

We have now had the opportunity to fully consider your request and I provide a response for your attention.

Following receipt of your request, searches were conducted with both the Criminal Justice Department and the Fixed Penalty Unit of Northumbria Police.  I can confirm that the information you have requested is held, in part, by Northumbria Police.

I have decided to disclose the located information to you as follows.

1. Please note that a 'charge' is not the usual disposal for 'using hand held mobile phone whilst driving', therefore we have provided the below table with disposal details for the dates specified by your request.

The recording system used by the Fixed Penalty Unit was introduced in mid 2005, therefore it has not been possible to provide the data regarding FPN's for 2004/05 as it is not held.

2. The youngest persons found to be driving whilst using a mobile were three 17 year olds.  Please note that there is no requirement to record the details surrounding the circumstances.  However, I can advise that  one of the 17 year olds was seen by a police officer using their mobile phone whilst driving and subsequently stopped.

3. The oldest person found to be driving whilst using a mobile was 79 and they were issued with a FPN.  The individual was parked on or near a roundabout using a mobile with the engine running.  No further details surrounding the circumstances can be supplied as these are not recorded on the FPN.
