Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')(FOIA)

Thank you for your email dated 15th February 2012 in which you made a request for access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of access to information held by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked: 

  1. When did the force begin implementing Sarah's Law?

  2. How many requests for information under Sarah's Law has the force received since it was implemented?

  3. For each financial year since Sarah's Law was implemented, please state:
    a) the number of requests made
    b) the number of requests granted
    c) the number of requests refused
    d) the number of granted requests that were positive (i.e. subject of the request was a sex offender)
    e) the number of granted requests that were negative (i.e subject of the request was not a sex offender)

  4. How many sex offenders whose details were disclosed by the force under Sarah's Law have subsequently reported being a victim of crime or anti-social behaviour as a result of that disclosure?

    Where possible, please specify what these alleged crimes were (e.g. assault, arson, criminal damage, robbery).

  5. Please provide a copy of the force's policy relating to disclosures under Sarah's Law.

In response:

We have now had the opportunity to fully consider your request and I provide a response for your attention.

Following receipt of your request, searches were conducted with the Crime and Legal Departments of Northumbria Police.  I can confirm that the information you have requested is held, in part, by Northumbria Police.

I have today decided to disclose the located information to you as follows.

  1. As the information you have requested at this part of your request is accessible by other means I have not provided you with a copy of the information and will rely on Section 21 of the Freedom of Information Act 2000.  You should therefore consider this a refusal for your request.

    I have provided an explanation to this exemption below.

    Information which is reasonably accessible to the applicant is exempt information.

    c) 3 Subjects could not be positively identified from the information given by the applicant and 1 request is currently pending as to whether we are to proceed.

    e) 2010-11: 18 and 2011-12:  24
