Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')  

Thank you for your e mail dated 23 December 2016 in which you made a request for access to certain information which may be held by Northumbria Police. 

As you may be aware the purpose of the Act is to allow a general right of access to information held at the time of a request, by a Public Authority (including the Police), subject to certain limitations and exemptions. 

You asked: 

In the last three financial years (2015-15, 2015-16, and 2016-17 so far) please name any third parties or companies who have purchased data from your force. This only relates to instances where money has been exchanged - not all cases where data belonging to your force may have been shared. 

By data, I mean any information held by your force which is not automatically published in crime statistics - and has been given to third parties, companies, organisations etc. for a fee.  

For each instance, please provide the year, the type of data which was passed on, the name of the company, and the amount of money paid. 

We have now had the opportunity to fully consider your request and I provide a response for your attention.

Following receipt of your request, searches were conducted within Northumbria Police. I can confirm that the information you have requested is held by Northumbria Police however cannot be dislcosed for the following reasons.

The information is not held centrally nor in a format that allows retreival within the permitted time constraints of the Act.  There will be many instances where data is is legally obtained upon the payment of a fee, ie by insurance companies on behalf of their insured for RTCs and Crimes, by solicitors requesting information on behalf of clients, or to assist them with representation, or individuals requesting data to proceed with civil claims. Such criteria would also include individuals seeking their own data through the Subject Access route under the Data Protection Act. All of these instances can attract different fees, either as a standard fee payable or those charged on a case by case basis.   We have estimated that to extract the information requested would take well in excess of the permitted 18 hours, therefore Section 12(1) of the Freedom of Information Act would apply.  This section does not oblige a public authority to comply with a request for information if the authority estimated that the cost of complying with the request would exceed the appropriate limit of 18 hours, equating to £450.00 

You should consider this to be a refusal notice under Section 17 of the Act for that part of your request.

When applying Section 12 exemption our duty to assist under Section 16 of the Act would normally entail that we contact you to determine whether it is possible to refine the scope of your request to bring it within the cost limits.  However, from the information we have outlined above I see no reasonable way in which we can do so.
