Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')(FOIA)
Thank you for your email dated 7 March 2012 in which you made a request for access to certain information which may be held by Northumbria Police.
As you may be aware the purpose of the Act is to allow a general right of access to information held by a Public Authority (including the Police), subject to certain limitations and exemptions.
This is a freedom of information request about the total amount paid out in compensation by your police force over the period 2007-2012.
“Claim” is defined as any written demand for financial compensation or other relief arising from alleged unlawful acts or omissions in the course of police operations, including alleged misconduct, assault, false imprisonment, malicious prosecution, and misfeasance or private law claims under the Human Rights Act.
a) How much has your force paid out in compensation following claims?
b) How many claims have been brought against your force, or or members of it?
For each resolved claim please state:
a) The amount paid out in compensation
b) The charge faced by your force or officer(s)
c) How the claim was resolved e.g. including, but not limited to, through the courts, out of court,
d) The court ruling, if relevant, and the case name
e) Disciplinary action taken against anyone charged/convicted (including all internal disciplinary action)
f) The legal fees paid by the police (including a separate figure for the fees of the other party, if paid by the police).
For points 1 and 2 please provide information (Date / Charge / £ Amount / Claim Resolved By / Court Ruling and Case Name / Disciplinary Action Taken / £ Legal Fees) for the last five years including annual figures for each year from 2007 to 2012 (January - March). Please provide your answer in a spreadsheet (.xls) format in a table.
Please state how many unresolved claims are currently being brought and the year the claim was first filed.
We have now had the opportunity to fully consider your request and I provide a response for your attention.
Following receipt of your request, searches were conducted with the Legal Department and the Professional Standards Departments of Northumbria Police. I can confirm that the information you have requested is held by Northumbria Police.
I have decided to disclose the located information to you as follows.
For the purposes of our response we have interpreted the requestor's definition of "Claim" as being any claim falling within the cover of the Force's Public Liability policy.
Please note that all settlement figures provided in relation to compensation paid are for cases finalised within a specific year and may include settlements for cases lodged in previous years. Whilst a case may have more than one claim lodged within it, our computer system only allows us to record total settlement figures against a case and not against each specific claim.
Please also note it has not been possible within the time constraints of the Act to cross reference questions 2 b) and 2 e) with the other queries in question 2, as this part of the request is unique to the Professional Standards Department, the others are specific to our Legal Department.

You may be interested to know that Northumbria Police routinely publish information that has been disclosed by Northumbria Police in response to requests made under the Freedom of Information Act 2000 via the Disclosure Log.
