Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')
Thank you for your e mail dated 8 June 2016 in which you made a request for access to certain information which may be held by Northumbria Police.
As you may be aware the purpose of the Act is to allow a general right of access to information held at the time of a request, by a Public Authority (including the Police), subject to certain limitations and exemptions.
1.Under the Freedom of Information Act 2000, please can you tell me how many cases you have dealt with in recent years involving people who have entered the UK illegally, either by boat, ferry, lorry or train?
2.I appreciate that such cases are handed on to Border Force to deal with and that in many cases you will not make any arrests and may not even detain people.
Therefore if possible, please could you state how many INDIVIDUALS your force has passed on to immigration enforcement (ie Border Force) in each of the past three years (2013-14, 2014-15 and 2015-16).
3.If this is not possible using your databases, please state how many TIMES your force has passed people on to immigration enforcement (ie Border Force) in each of the past three years (2013-14, 2014-15 and 2015-16).
4.If that is not possible, please simply state how many people you have dealt with / detained / arrested on suspicion of entering the UK without leave) in each of the past three years (2013-14, 2014-15 and 2015-16).
5. I am sure you will have been asked similar questions recently so please do send me any recent responses you have sent out – but please do answer my questions separately.
We have now had the opportunity to fully consider your request and I provide a response for your attention.
Following receipt of your request, searches were conducted with the Corporate Development Department of Northumbria Police. I can confirm that the information you have requested is held by Northumbria Police and can be extracted for point 4 only within the permitted time constraints..
The following totals therefore are for the number of arrests for the offence "Non citizen entering UK without leave".
2013/14 - 60
2014/15 - 50
2015/16 - 39
5. As the information you have requested at this part is accessible by other means I have not provided you with a copy of the information and will rely on Section 21 of the Freedom of Information Act 2000. You should therefore consider this a refusal for your request.
I have provided an explanation to this exemption below.
Section 21 (1) - Information accessible by other means
Information which is reasonably accessible to the applicant is exempt information.

Additionally Northumbria Police can neither confirm nor deny that it holds any other information relevant to your request as the duty in Section 1(1)(a) of the Freedom of Information Act 2000 does not apply, by virtue of the following exemption:
Section 23(5) Information relating to the Security bodies
Section 23 is an absolute class-based exemption and therefore there is no requirement to conduct a harm or public interest test.

Systems used for recording these figures are not generic, nor are the procedures used locally in capturing the data.
