Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')(FOIA)

Thank you for your email dated 18 January 2012 in which you made a request for access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of access to information held by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked: 

  1. How many people aged 65 and over were arrested in the calendar years 2009, 2010 and 2011?

  2. For each person over 65 arrested, could you please include information on their age, gender and the crime they were arrested for.

  3. How people aged 16 and under were arrested in the calendar years 2009, 2010 and 2011?

  4. For each young person arrested, could you please include information on their age, gender and the crime they were arrested for.

I have attached a response from Sussex Police to a similar request and would be grateful if you could stick to a similar format.

We have now had the opportunity to fully consider your request and I provide a response for your attention.

Please note that under the Freedom of Information Act 2000 there is no obligation for the force to supply the information based on the requirements of the requestor.  When making a request for information, an applicant may express a preference for the way in which the information is received (ie electronic, hard copy etc), but not the actual format (ie spreadsheet).  We are only obliged to provide the information in the manner that we hold it and we are not required to create new information to respond to a request.  Therefore, we have supplied the required information in the format in which it is recorded.

Following receipt of your request, searches were conducted with the Corporate Development Department of Northumbria Police.  I can confirm that the information you have requested is held by Northumbria Police.

I have decided to disclose the located information to you as follows.

With regards to your request for information for the years 2009 and 2010, this information will not be disclosed in this request as the following exemption applies.

As the information you have requested is accessible by other means I have not provided you with a copy of the information and will rely on Section 21 of the Freedom of Information Act 2000.  You should therefore consider this a refusal for that part of your request.

I have provided an explanation to this exemption below.

Section 21 (1) - Information accessible by other means

Information which is reasonably accessible to the applicant is exempt information.
